The initial diagnosis information is quickly accessible to them even without a wifi or cellular connection.</p>

<p>WEG is a world class manufacturer of Variable Frequency Drives, also known as Variable Speed Drives. For medium voltage motors WEG has the MVW-01 Medium Voltage VFD. The MVW-01 is a highly versatile product that can provide speed control for motors up to 7,000 HP with input voltages from 2300V to 6600-6900V.</p>
<p>The MVW-01 combines the simplicity of control found in WEG’s low voltage VFD line with robust hardware to provide the user with a product that is simple, reliable and safe to use. WEG has reduced the number of components typically found in a Medium Voltage VFD resulting in higher efficiency, reliability and total cost of ownership.</p>
<p>A myriad of communication options including DeviceNet, Modbus, Profibus-DP and Ethernet/IP allows the MVW-01 to be integrated into existing systems.</p>
<p>The input rectifier has a multipulse diode configuration giving the power supply a high power factor meeting IEEE 519 requirements.</p>

Pamensky Canada Inc. opened a new panel shop in Toronto. WEG has an extensive range of motor control options to meet the needs of any application. V.J. Pamensky Canada Inc. is now using that product range and the new panel shop to deliver solutions to customers.</p>
<p>Pamensky has identified a few core needs for products in the marketplace. Enclosed Drive Panels (EDP) is a general purpose package that provides many options for AC motor control and protection.  Designed for quick installation and start-up, this drive panel requires only input power and output motor connections. The EDP is a complete, cost effective solution for driving, monitoring and protecting electric motors.</p>
<p>The standard EDP package includes a WEG Variable Frequency Drive (VFD) with a door mounted keypad, through door disconnect and a control power transformer. All of this is mounted in a NEMA 12 ventilated enclosure. Having the panel shop located locally in the Toronto warehouse allows Pamensky to offer several options to meet the specific needs of the customer like load and line reactors, and panel control options including start/stop pushbuttons, run/stop/fault pilot lights and a local/remote selector switch.</p>
<p>Combination Soft Starters (GPH) is the standard package for soft starter applications for the Pamensky panel shop combing a WEG soft starter, door mounted keypad, through door disconnect and a control power transformer in a NEMA 4/12 enclosure.</p>
<p>The local nature of the shop also allows Pamensky to offer custom designed panel solutions for many variable frequency drive, soft starter and across the line starter applications.</p>

WEG and V.J. Pamensky Canada Inc. were proud to be one of the exhibitors there.</p>
<p>The show took place over Friday evening and Saturday afternoon and was an opportunity to see many of our customers face to face. The show was well attended and our staff was able to  have many good discussions with customers.</p>
<p>On display were varied WEG products including Rolled Steel motors, W22 Severe Duty Motors, Variable Frequency Drives (including NEMA 4X), Industrial Control Products, and Labyrinth Tachonite and WEG WSeals.</p>
<p>We are looking forward to next year&#8217;s show.</p>

However, in addition to complex medium and long term planning, these investments rely on natural resources, which are becoming depleted due to constant pressures upon the environment. The best strategy, therefore, to maintain energy supply in the short term is to avoid waste and increase energy efficiency. Electric motors play a major role in this strategy; since around 40% of global energy demand is estimated to be related to electric motor applications. Consequently, any initiatives to increase energy efficiency, by using high efficiency electric motors and frequency inverters, are to be welcomed, as they make a real contribution to reductions in global energy demand.</p>
<p>At the same time as efficiency initiatives make an impact in traditional market sectors, the application of new technologies in emerging sectors is resulting in profound changes in the way that electric motors are applied and controlled. By integrating these changes together with the demands for increased energy efficiency, WEG has taken up the challenge and produced a new design of high efficiency electric motor; one that exceeds the performance of WEG’s previous W21 motor line, which is recognized worldwide for its quality, reliability and efficiency.</p>
<p>Using the latest generation of computerized tools, such as structural analysis software (finite element analysis) and computer fluid dynamics, as well as electrical design optimization software, an innovative, next generation product has been developed: the <strong>W22 electric motor</strong>.</p>

They are a world class manufacturer of industrial electric equipment. WEG is built on a foundation of vertical integration that gives them the ability to control the quality of all of their products. This is the first in a series of articles highlighting some of WEG’s manufacturing process.</p>
<p><img class="alignright size-full wp-image-863" title="WEG_Foundry" src="http://www.pamensky.com/wp-content/uploads/2012/01/3663527418_a700a2bfc9.jpg" alt="" width="233" height="350" />WEG has several foundries on site where they make their own cast iron. By investing in new technologies WEG is able to strictly control the quality and consistency of their cast iron frames. WEG’s newest foundry is almost wholly automated, bringing some of the world’s most advanced technology to bear in the manufacturing process. The new foundry consists of a 6000kW induction power supply connected to two 8 ton Heavy Steel Shell furnaces, a 1000kW induction power supply connected to a 60/71 ton channel furnace that is used for holding molten metal. An Automated Pressure Pouring System with vision pouring controls makes casting safer and more precise. All equipment in the foundry can be controlled as one system.</p>
<p>WEG cast iron parts are then machined with the exacting levels of precision that WEG demands of its manufacturing process and products. More than 40,000 cast iron parts are machined every day at the main WEG facilities in Jaragua do Sul in Brazil.</p>

<p>Petrobras, Brazil’s largest Oil and Gas producer contracted Single Buoy Moorings (SBM) to design and build the P-57 Floating Production, Storage and Offloading unit (FPSO). SBM chose WEG to supply critical electrical equipment for the project including Medium Voltage Panels, Low Voltage Panels, Motor Control Centers (MCCs), Medium and Low Voltage Dry Transformers, Electric Motors and Variable Frequency Drives.</p>
<p>WEG Electric Motors are being used on P-57 for oil, water and fire fighting pumps and some general purpose pumps. All products for this project meet the strict requirements for ABS certification and most of the equipment also has certification for use in hazardous locations.</p>
<p>WEG has a long history of supplying products designed to meet the tough demands of Oil and Gas applications. In Canada, WEG products are currently in use in drilling, oil sands and offshore applications. WEG products are built to exacting standards for quality. WEG also produces electric motors for Top Drive, Mud Pump and Drawworks applications. WEG Automation products are also used in E-Houses for oil drilling operations.</p>
<p>Products for P-57 were supplied through WEG branches in Europe and several OEMs making use of WEG’s vast worldwide network of branches and partners. WEG’s experience in doing business internationally helped them meet the aggressive construction schedule.</p>
<p>P-57 is now operating at Parque das Baleias in Brazil extracting 180 thousand barrels of oil and 2 million cubic meters of gas per day.</p>

<p>WEG has announced the availability of the new WGM Line of Water Jacket Cooled Electric Motors. These motors are designed for use in extreme situations and environments.  These WEG WGM motors have a special water cooling system to keep thermal efficient, meaning that even in the most extreme environments the motor remains cool. Water is circulated through the water jacket system between the frame and the stator core to keep effective thermal exchange between the water and the motor. This also results in a higher ratio of output power versus frame size. A side effect is the minimizing of heat exchange between with the environment, cooling the bearings without the need for an independent cooling system.</p>

<p>“Water-cooled WGM motors are perfect for variable speed applications, since the thermal efficiency is optimized, even on reduced speeds, where space is a concern,” said Steve Waite, Large Machines Manager, WEG Electric Corp. “Harsh environments with high temperatures, limited space or dusty conditions are ideal for the use of the Water Jacket Cooled Motor.”</p>
<p>Many industries will be able to make use of the WGM Line including Mining, Oil &amp; Gas, Steel, Pulp and Paper, Cement, Marine Duty, Wind Energy and more.</p>
<p>The WGM line is available from 400 to 3750 HP in voltages of 690V to 6.6kV. Suitable for horizontal or vertical mounting in NEMA frames 5000 to 8800 and IEC frames 315 to 560. The motors are 2 pole to 8 pole and available in 50Hz or 60Hz configurations.</p>

			<content:encoded><![CDATA[<p><strong>TERMS AND CONDITIONS OF SALE V.J. PAMENSKY CANADA INC.</strong></p>
<p><strong>1. EXCLUSIVE CONDITIONS OF SALE:</strong> This Quotation or Order is subject to terms and conditions contained here-in and supersedes Buyer’s Specification and/or Purchase Order. Seller will recognize no modifications or additions to these conditionsunless specifically agreed to in writing by Seller. Failure of Seller to object to provisions contained in the Purchaser’s Order or any other communication from Buyer shall not be construed as a waiver of these conditions or an acceptance of any such provisions. If Buyer places an Order with Seller based on Seller’s Quotation, whether the Order is placed in writing or orally, then the Quotation (including Seller’s terms and conditions) and the Seller’s acceptance of the Order will constitute the entire contract between Buyer and Seller with respect to the subject matter thereof notwithstanding any terms and conditions inconsistent with these terms and conditions on any of Buyer’s forms or correspondence. All orders, sales contracts and other documentation between Buyer and Seller shall become effective only when approved and accepted by the Seller.</p>
<p><strong>2. PRICES: </strong>Prices quoted herein are based upon presently prevailing duties, rates of duties, taxes, special assessments, monetary exchange and freight as applied to materials and/or equipment purchased or imported by Seller. Seller reserves the right to amend the price(s) in this quotation where variations in regulated costs such as rate of duties, taxes, special assessments, monetaryexchange and freight between the date of quotation and date of delivery are deemed significant by the Seller.</p>
<p><strong>3. TERMS OF PAYMENT: </strong>The standard terms of payment are Net-30 Days from date of invoice, with a service and interest charge of 1-1/2% per month (18% per annum) on past due invoices applying. If Buyer defaults in any payment when due or refuses to accept delivery or becomes insolvent, the Seller at its option, without prejudice to other lawful remedies, may defer deliveries or cancel the remainder of the order. Equipment held for Buyer shall be at the risk and expense of Buyer and payment shall become due from the date of which Seller is prepared to make shipment. Printed terms on face of our Quotation will take precedence.</p>
<p><strong>4. TITLE:</strong> Title to the goods covered by this Quotation and the right to immediate possession thereof shall remain with the Seller until the purchase price is paid in full and Buyer hereby grants to Seller a security interest in the equipment (and all proceeds thereof) to secure the Buyer’s obligation to pay for the equipment.</p>
<p><strong>5. CERTIFICATIONS AND TAXES:</strong> Prices do not include sales, use or other similar federal, state or local taxes. Any certification for special duty or tax rate must be supplied at time of order. A service charge will be applied on any credit notes necessitated by the Buyer not providing proper certification at time of order. Exception from taxes extended to the buyer does not prejudice our right to charge the buyer with taxes plus any penalties assessed at any subsequent date should the taxing authorities determinethat the equipment is taxable.</p>
<p><strong>6.  PENALTIES AND DELAYS: </strong>No penalty clause of any kind, in any specification of order will be effective unless specifically approved in writing by Seller. Seller shall not be liable for any damage, expenses or consequential damages caused by delays beyond Seller’s control including without limiting the generality of the foregoing; fire, strike, act of the Buyer, restriction by civil or military authority, Act of God, transportation failures or inability to obtain labor, materials or manufacturing facilities. In the event of any such delay, the date of delivery shall be extended for a period equal to the time lost by reason of the delay.</p>
<p><strong>7. CANCELLATION: </strong>Orders once accepted are not subject to cancellation unless on terms that will indemnify Seller against loss and/or expenses incurred.</p>
<p><strong>8. SHIPMENT: </strong>Unless otherwise specified in writing, all shipments are EX-WORKS (Incoterms 2000) Seller’s shop, in which case Seller is not responsible for damage, apparent or concealed, or loss in transit and all claims on “collect” shipments must be made by Buyer direct to the carrier. Seller will assist insofar as practical in securing satisfactory adjustment to reasonable claims.</p>
<p><strong>9.  ACCEPTANCE, INSPECTION: </strong>By virtue of Buyer issuing an order for equipment in accordance with this Quotation, he also accepts Seller’s Terms and Conditions as part of the order. Buyer shall inspect the goods immediately upon the receipt thereof.  All claims by Buyer (including claims for shortages), except only those provided for under the WARRANTY clauses below, must be asserted in writing by Buyer within a 10 day period or they are waived.  If this contract involves partial performances, all such claims must be asserted within a 10-day period for each partial performance.</p>
<p><strong>10. WARRANTY: </strong>Seller warrants to the Buyer that its products are free from defects in workmanship and materials when operated under normal conditions and in accordance with nameplate characteristic limits.   This warranty will be in effect for the following time period and for the following products:</p>
<ol>
<li>Low voltage standard efficiency motors NEMA &amp; IEC frames are warranted for a period of 12 months from date of installation, but not more than 18 months from date of manufacture.</li>
<li>EPACT &amp; NEMA Premium Efficiency motors both NEMA &amp; IEC frames are warranted for a period of 24 months from date of installation but for not more than 30 months from date of manufacture.</li>
<li>IEEE841 motors are warranted for a period of 60 months from date of installation but for not more than 66 months from date of manufacture.</li>
<li>Machines &amp; Generators are warranted for a period of 12 months from date of installation, but not more than 18 months from date of manufacture.  These products include but are not limited to; Above NEMA size Motors: low voltage, medium voltage and high voltage, DC motors, Turbo Generators, Hydro Generators, Synchronous Motors, and Wound Rotor Motors.</li>
<li>Automation products (variable frequency drives and soft starters) and Electrical components are warranted for a period of 12months from date of installation, but not more than 18 months from date of manufacture. If any defects are claimed by the Buyer during the warranty period, Seller’s sole obligation shall be limited to alteration, repair or replacement at Seller’s expense, EX-WORKS (Incoterms 2000) Seller’s shop, on parts or equipment which upon return to Buyer and upon Buyer’s examination prove to be defective.</li>
</ol>
<p>UNLESS OTHERWISE SPECIFIED IN WRITING HEREIN, THERE  ARE NO REPRESENTATION, WARRANTIES OR CONDITIONS, EXPRESSED OR IMPLIED STATUTORY OR OTHERWISE, EXCEPT FOR THE FOREGOING AND WITHOUT LIMITING THE GENERALITY OF THE ABOVE, THERE ARE NO EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES CONCERNING THE QUALITY OF THE EQUIPMENT OR THAT ANY SUCH EQUIPMENT WILL BE FIT FOR ANY PARTICULAR PURPOSE OF THE PURCHASER.  THE SELLER SHALL HAVE NO OBLIGATION TO REPAIR OR REPLACE SUCH  PRODUCTS OR PARTS UNLESS IT RECEIVES AT ITS OFFICES IN CANADA WRITTEN NOTICE OF SUCH DEFECT WITHIN THE ABOVE-MENTIONED WARRANTY PERIOD.</p>
<p>This warranty does not cover the cost of transportation, labor, removal, installation, or re-testing of the new or repaired goods or parts, or any other direct or incidental expenses incurred in shipping the product to or from Seller.  Replacement goods or parts are warranted for the remainder of the warranty period applicable to the goods originally supplied by the seller.  No warranty shall apply to any equipment upon which repairs or alterations have been made unless authorized by Seller, nor to equipment which hasbeen subjected to misuse, negligence or mishandling.</p>
<p><strong>11. DAMAGES: </strong>Subject to the balance of the provisions of this clause, Seller shall only be liable for the cost of replacement of any defective Equipment provided hereunder. Seller shall not be liable to the Buyer in any circumstances for any incidental, special, consequential or indirect damages, including but not limited to loss of profits or revenue, loss of use of equipment and facilities, and claims by or payments to customers, suppliers or other parties who have a relationship with the Buyer. This disclaimer applies to consequential damages based upon any cause of action whatever asserted against Seller including causes of action arising out ofany breach of warranty, express or implied, guarantee, product liability, negligence, tort, or any other cause pertaining to the performance or non-performance of this Quotation or contract by Seller and the Buyer hereby waives any right to claim punitive,aggravated or exemplary damages with respect to a breach of  this Quotation or the performance or non-performance of the Equipment, and whether such claim is founded in contract, tort or otherwise. Seller shall not be responsible for losses or damages arising out of the negligence of the Buyer, its’ employees, agents or third party contractors. In no event will Sellers maximumliability to the Purchaser in connection with the Equipment, including without limitation resulting from breach of contract or  any other performance or non-performance of this Quotation or contract, exceed the amount of the purchase price paid to Seller hereunder.</p>
<p><strong>12.  RETURNING EQUIPMENT: </strong>No equipment is to be returned without first obtaining from Seller shipping instructions and a return material identification number and agreement in writing as to terms. Returned equipment, which Seller elects to accept for credit is subject to reasonable handling and restocking charge commensurate with the policy of the manufacturer plus all charges incurred by Seller. Seller is not responsible for equipment that is returned without complying with the foregoing. Equipment isreturned at the expense and risk of the Buyer.  Returned equipment must be in the original packaging and unused.</p>
<p><strong>13. PRIVILEGE AND LIEN RIGHTS: </strong>Seller retains all lien rights with regard to the equipment in accordance with any Builder’s Lien Act, Mechanic’s Lien Act, Builder and Works Act or other legislation passed pursuant to or in replacement thereof.</p>
<p><strong>14.  BACK CHARGES: </strong>Seller will accept no back charges for any reason without Seller’s written permission to incur such back charges.</p>
<p><strong>15.  TECHNICAL ADVICE: </strong>Any technical advice furnished or recommendation made by Seller or any representative of Seller concerning any use or application of any of the goods is believed to be reliable, but SELLER MAKES NO WARRANTY, EXPRESSED OR IMPLIED, ON RESULTS TO BE OBTAINED.  BUYER ASSUMES ALL RESPONSIBILITY FOR LOSS OR DAMAGE RESULTING FROM THE HANDLING OR USE OF ANY OF THE GOODS.</p>
<p><strong>16. INVALIDITY: </strong>If any provision of this contract shall be found to be invalid or illegal by reason of any determination made by a court of competent jurisdiction or any governmental authority having jurisdiction in the circumstances, such provisions shall be severed from this contract to the extent of such invalidity or illegality and the validity, legality or enforceability of the remaining provisions of this contract shall not in way be affected or impaired thereby. Waiver of any default shall not be a waiver of any other or subsequent default.</p>
<p><strong>17. GST NUMBER: </strong>V.J. Pamensky Canada Inc. GST Number is 105553648</p>
<p><strong>18. APPLICABLE LAWS AND FORUM:</strong> This contract shall be interpreted in accordance with and shall be governed by the laws of the Province of Ontario, and the parties agree that any disputes hereunder or with respect to this quotation or the resulting contract between the parties shall be determined exclusively by the Courts in the Province of Ontario, and the parties hereby expressly attorn to the exclusive jurisdiction of the Courts in the Province of Ontario.</p>
<p><strong>19.  LANGUAGE: </strong>The parties acknowledge that they have required that this contract and all related documents be prepared in English. Les parties reconnaissent avoir exige que la présente convention et tous les documents connexes solent rédigés en anglais. If the Buyer requests, a French version of this agreement will be used.</p>
<p><strong>20.   LIABILITY: </strong>Notwithstanding anything to the  contrary herein contained, the Liability of the Seller under any circumstances whatsoever and without exception shall be limited to the Purchase Price of the particular item forming part of the goods.</p>
<p><strong>MODALITÉS ET CONDITIONS DE VENTE V.J. PAMENSKY CANADA INC.</strong></p>
<p><strong>1. CONDITIONS DE VENTE EXCLUSIVES : </strong>Le devis ou la commande sont sous réserve des modalités et conditions contenues aux présentes et remplace les spécifications ou le bon de commande de l’acheteur. Le vendeur ne reconnaîtra aucune modificationni ajout à ces conditions à moins d’un accord écrit particulier de sa part. L’omission du vendeur de faire objection aux dispositions contenues dans toute commande du client ou toute autre forme de communication de la part de l’acheteur ne doit pas être interprétée comme une renonciation à ces conditions ou l’acceptation d’une quelconque disposition. Si l’acheteur passe une commande auprès du vendeur d’après le devis du vendeur, que la commande soit par écrit ou verbalement, ce devis (y compris ces modalités et conditions) et l’acceptation de la commande par le vendeur constitueront l’intégralité du contrat entre l’acheteur et le vendeur eu égard à son objet, et ce, nonobstant toutes modalités et conditions pouvant aller à l’encontre des modalités et conditions indiquées sur tout imprimé ou dans toute correspondance de l’acheteur. Toutes les commandes, tous les contrats de vente et tout autre document produit entre l’acheteur et le vendeur n’entrent en vigueur qu’à compter de l’approbation et de l’acceptation du vendeur.</p>
<p><strong>2. PRIX :</strong> Les prix indiqués aux présentes sont basés sur les droits de douane, les taux de droits de douane, les taxes, les évaluations spéciales, le taux de change et les frais de transport courants, qui s’appliquent au matériel ou à l’équipement acheté ou importé par le vendeur. Le fournisseur se réserve le droit de modifier le(s) prix indiqué(s) sur ce devis lorsque le fournisseur considère que les variations des coûts réglementés — tels que le taux de droits de douane, les taxes, les évaluations spéciales, le taux de change et les frais de transport — pouvant s’être produites entre la date du devis et la date de livraison, sont importantes.</p>
<p><strong>3. MODALITÉS DE PAIEMENT : </strong>Les modalités de paiement normales sont de net dans 30 jours à compter de la date de la facture et des frais de gestion de 1 ½ % par mois (18 % par année) s’appliquent sur les factures en souffrance. Si l’acheteur fait défaut de verser un paiement échu ou refuse d’accepter une livraison ou devient insolvable, le vendeur, à sa seule discrétion et indépendamment de tous les autres recours légitimes, peut différer la livraison ou annuler le reste de la commande. L’équipement retenu pour l’acheteur l’est alors à ses risques et à ses frais, et le paiement devient échu à compter de la date à laquelle le vendeur est prêt à procéder à l’expédition. Les modalités figurant au recto de notre devis ont préséance.</p>
<p><strong>4. TITRE : </strong>Le titre de propriété des marchandises indiquées sur ce devis ainsi que le droit à la possession immédiate de celles-ci demeurent ceux du vendeur jusqu’à ce que le prix d’achat lui ait été intégralement payé; par conséquent, l’acheteur accorde au vendeur un droit de sûreté sur l’équipement (et sur tous les produits monétaires correspondants) afin de garantir au vendeur qu’il respectera son obligation de payer l’équipement en question.</p>
<p><strong>5. CERTIFICATIONS ET TAXES : </strong>Les prix ne comprennent pas les taxes de vente, les taxes d’utilisation ni les autres taxes fédérales, provinciales ou locales. Toute certification de droits de douane ou de taux de droits de douane spéciaux doit être spécifiée au moment de la commande. Des frais de gestion seront appliqués sur toute note de crédit exigée par l’acheteur si ce dernier n’a pas fourni la certification appropriée au moment de la commande. Les exemptions de taxes accordées à l’acheteur ne portent pas préjudice à notre droit d’exiger que l’acheteur paie des taxes ainsi que toute pénalité qui sera établie à une dateultérieure si les autorités taxatrices déterminent que l’équipement vendu est taxable.</p>
<p><strong>6. PÉNALITÉS ET RETARDS :</strong> Aucune clause de pénalité quelconque, dans toute spécification de commande, ne sera exécutoire à moins d’avoir été spécifiquement approuvée par écrit par le vendeur. Le vendeur ne peut être tenu responsable des dommages, des frais ou des dommages consécutifs entrainés par des retards indépendants de la volonté  du vendeur, y compris, mais sans s’y limiter, les dispositionsgénérales de ce qui précède; un incendie, une grève, un geste de  la part de l’acheteur, une restriction de la part d’une autorité civile ou militaire, un cas fortuit, une défaillance de la part du transporteur ou l’incapacité de se procurer de la main-d’œuvre, du matériel ou des installations de production. Dans l’éventualité d’un tel retard, la date de livraison doit être reportée pendant une période équivalant au temps perdu en raison du retard.</p>
<p><strong>7. ANNULATION :</strong> Une fois acceptées, les commandes ne peuvent être annulées, à moins qu’une indemnité soit versée au vendeur afin de compenser la perte qu’il a subie ou les dépenses qu’il a engagées.</p>
<p><strong>8. EXPÉDITION : </strong>À moins d’indication contraire par écrit, toutes les expéditions sont faites ENU à partir de l’atelier du vendeur (Incoterms 2000); le cas échéant, le vendeur n’est pas responsable des dommages, apparents ou non, ou des pertes survenues durant le transport, et l’acheteur doit effectuer directement  auprès du transporteur toutes les réclamations ayant trait aux expéditions « port à percevoir ». Dans la mesure où il le peut, le vendeur aidera les parties à négocier des ajustements satisfaisants afin d’en arriver à des réclamations raisonnables.</p>
<p><strong>9. ACCEPTATION ET INSPECTION : </strong>L’acheteur, en vertu de l’émission d’une commande d’équipement, conformément à ce devis, accepte également les modalités et conditions du vendeur, lesquelles font partie intégrante de la commande. L’acheteur doit inspecter les marchandises dès leur réception. Toutes les réclamations de l’acheteur (y compris les réclamations en raison de rupture de stock), à l’exception de celles stipulées dans les clauses de GARANTIE ci-dessous, doivent être faites par écrit dans un délai de 10 jours, faute de quoi l’acheteur doit y renoncer. Si le présent contrat prévoit des exécutions partielles, lesdites réclamations doivent être faites dans un délai de 10 jours, et ce, pour chaque exécution partielle.</p>
<p><strong>10. GARANTIE :</strong> Le vendeur garantit ses produits contre tous défauts de fabrication et de matériaux, s’ils sont utilisés dans des conditions normales et conformément à leur capacité nominale. Cette garantie porte sur les produits suivants  est en vigueur pour la période de temps suivante :</p>
<p>a) Les bâtis NEMA et CEI des moteurs à faible tension et à rendement standard sont garantis pour une période de 12 mois à compter de la date d’installation, mais pour pas plus de 18 mois à compter de la date de fabrication.</p>
<p>b)  Les bâtis NEMA et CEI des moteurs EPACT et NEMA à haut rendement sont garantis pour une période de 24 mois à compter de la date d’installation, mais pour pas plus de 30 mois à compter de la date de fabrication.</p>
<p>c) Les moteurs IEEE841 sont garantis pour une période de 60 mois à compter de la date d’installation, mais pour pas plus de 66 mois à compter de la date de fabrication.</p>
<p>d)  Les appareils et générateurs sont garantis pour une période de 12 mois à compter de la date d’installation, mais pour pas plus de 18 mois à compter de la date de fabrication. Ces produits comprennent, sans toutefois s’y limiter, les moteurs de capacité NEMA mentionnés précédemment : à faible tension, à tension moyenne, à haute tension, les moteurs CC, les turbogénérateurs, les hydrogénérateurs, les moteurs synchrones et les moteurs à rotor bobiné.</p>
<p>e) Les produits d’automatisation (mécanismes d’entraînement à fréquence variable, démarreurs progressifs) et les composants électriques sont garantis pour une période de 12 mois à compter de la date d’installation, mais pour pas plus de 18 mois à compter de la date de fabrication.</p>
<p>Si l’acheteur fait une réclamation pour tout défaut au cours de la période de garantie, la seule obligation du vendeur se limitera à la modification, à la réparation ou au remplacement, à ses propres frais, ENU à partir de l’atelier du vendeur (Incoterms 2000), des pièces ou de l’équipement que l’acheteur aura retournés et qui, après examen du vendeur, s’avèrent défectueux. À MOINS D’INDICATIONS CONTRAIRES FIGURANT PAR ÉCRIT AUX PRÉSENTES, IL N’Y A AUCUNE REPRÉSENTATION NI GARANTIE NI CONDITION, EXPRESSE OU IMPLICITE, PRESCRITE PAR LA LOI OU AUTREMENT, À L’EXCEPTION DE CE QUI PRÉCÈDE, ET SANS LIMITER LA PORTÉE GÉNÉRALE DE CE QUI PRÉCÈDE, IL N’Y A AUCUNE REPRÉSENTATION NI GARANTIE EXPRESSE OU IMPLICITE QUANT À LA QUALITÉ DE L’ÉQUIPEMENT OU SELON LAQUELLE  LEDIT ÉQUIPEMENT CONVIENT À L’UTILISATION PARTICULIÈRE QU’EN FAIT L’ACHETEUR. LE VENDEUR N’A AUCUNE OBLIGATION DE RÉPARER OU DE REMPLACER DE TELS PRODUITS OU DE TELLES PIÈCES À MOINS D’AVOIR REÇU, À SES BUREAUX AU CANADA, UN AVIS ÉCRIT LUI SIGNALANT LEDIT DÉFAUT AU COURS DE LA PÉRIODE DE GARANTIE MENTIONNÉE PRÉCÉDEMMENT.</p>
<p>Cette  garantie  ne  couvre  pas  le  coût  du  transport,  de  la  main-d’œuvre, de la dépose, de l’installation ou des nouveaux tests effectués sur les produits ou les pièces neuves ou réparées, ni tous les autres frais directs ou indirects engagés dans le cadre de l’expédition du produit chez le vendeur ou par celui-ci. Les produits ou les pièces de remplacement sont garantis pour le reste de la période de garantie en vigueur sur les produits fournis à l’origine par le vendeur. Aucune garantie ne s’applique à de l’équipement ayant subi des réparations ou des modifications sans l’autorisation du vendeur, ni à de l’équipement ayant fait l’objet d’un usage abusif, de négligence ou d’un usage incorrect.</p>
<p><strong>11. DOMMAGES : </strong>Sous réserve du reste des dispositions de cette clause, le fournisseur est uniquement responsable du coût du remplacement de tout équipement défectueux fourni en vertu des présentes. Le fournisseur n’a aucune responsabilité envers l’acheteur, en aucune circonstance, quant aux dommages consécutifs, particuliers ou indirects, y compris, mais sans s’y limiter, la perte de profits ou de revenu, la perte de l’utilisation d’équipement ou d’installations, et les réclamations des clients, des fournisseurs ou d’autres parties qui sont en relation avec l’acheteur ou les paiements faits à ceux-ci. Cette clause de nonresponsabilité s’applique aux dommages indirects sur la base de toute cause d’action affirmée contre le fournisseur, notamment les causes d’action découlant de toute rupture  de garantie, expresse ou implicite, d’une  garantie, d’une responsabilité de produits, d’une négligence, d’un acte dommageable ou de toute autre cause ayant trait à l’exécution ou à la non-exécution de ce devis ou de ce contrat par le fournisseur; par conséquent, l’acheteur renonce à tout droit de réclamer des dommages punitifs, alourdis ou exemplaires eu égard à une rupture de ce devis ou au fonctionnement ou au non-fonctionnement de l’équipement, et ce, peu importe qu’une telle réclamation soit fondée sur la responsabilité contractuelle, extracontractuelle ou autre. Le fournisseur ne peut être tenu responsable de pertes ou de dommages découlant de la négligence de l’acheteur, de ses employés, de ses agents ou de toute partie contractante en tiers. En aucun cas la responsabilité maximale du fournisseur envers l’acheteur en ce qui a trait  à l’équipement, y compris, mais sans s’y limiter, toute responsabilité découlant d’une rupture de contrat ou de toute autre exécution ou non-exécution de ce devis ou contrat, ne peut excéder le prix d’achat payé au fournisseur en vertu des présentes.</p>
<p><strong>12. RETOUR DE L’ÉQUIPEMENT :</strong> Aucun équipement ne peut être retourné sans d’abord avoir obtenu du vendeur des instructions d’expédition et un numéro d’identification de retour de matériel ainsi qu’une entente écrite portant sur les modalités. Des frais raisonnables de manutention et de remise en stock correspondant à la politique du fabricant ainsi que tous les frais engagés par le vendeur s’appliquent à l’équipement retourné que le vendeur choisit d’accepter en échange d’un crédit. Le vendeur n’est pas responsable de l’équipement retourné sans tenir compte de ce qui précède. L’équipement est retourné aux frais et aux risques del’acheteur. L’équipement doit être retourné dans son emballage d’origine et ne doit pas avoir été utilisé.</p>
<p><strong>13. PRIVILÈGES ET DROITS DE PRIVILÈGE :</strong> Le vendeur conserve tous les droits de privilège quant à l’équipement, et ce, conformément à toute loi sur les privilèges des constructeurs, toute loi sur les privilèges des mécaniciens, toute loi sur les constructeurs et les travaux ou toute autre loi adoptée en la matière ou en remplacement de ce qui précède.</p>
<p><strong>14. FRAIS DE DÉDOMMAGEMENT : </strong>Le vendeur n’acceptera la responsabilité d’aucuns frais de dédommagement, pour quelque raison que ce soit, sans sa permission écrite d’engager de tels frais.</p>
<p><strong>15. CONSEILS TECHNIQUES :</strong> Tout conseil technique fourni ou toute recommandation faite par le vendeur ou par tout représentant du vendeur en ce qui a trait à l’utilisation ou à l’application de tout produit est considéré comme fiable; cependant, LE VENDEUR N’ÉMET AUCUNE GARANTIE, EXPRESSE OU IMPLICITE, SUR LES RÉSULTATS OBTENUS. L’ACHETEUR ASSUME L’ENTIÈRE RESPONSABILITÉ DES PERTES OU DES DOMMAGES DÉCOULANT DE LA MANUTENTION OU DE L’UTILISATION DE TOUT PRODUIT.</p>
<p><strong>16. INVALIDITÉ :</strong> Si l’une ou l’autre des clauses de ce contrat est éventuellement déclarée invalide ou illégale par un tribunal compétent ou toute autorité gouvernementale compétente, selon le cas, cette clause doit être expurgée du contrat, dans la limite où une telle invalidité ou illégalité, et dans la limite où la validité, la légalité ou la force exécutoire des autres clauses du contrat ne s’en trouve pas modifiée ni altérée. La non-responsabilité  quant à un défaut en particulier ne constitue en rien une nonresponsabilité quant à tout autre défaut ou à tout défaut ultérieur.</p>
<p><strong>17. DOMICILE :</strong> Par les présentes, l’acheteur accepte d’élire domicile dans la province du vendeur auprès duquel il a passé sa commande de produits.</p>
<p><strong>18. NUMÉRO DE TPS :</strong> Le numéro de TPS de V.J. Pamensky Canada Inc. est le 105553648.</p>
<p><strong>19. LOIS EN VIGUEUR ET TRIBUNAL : </strong>Ce contrat est régi par les lois de la province de l’Ontario et doit être interprété selon celles-ci. Les parties reconnaissent que tout litige en vertu des présentes ou en ce qui a trait à ce devis ou au contrat qui en résulte entre les parties doit être réglé exclusivement par les tribunaux de la province de l’Ontario. Par conséquent, les parties acquiescent de la compétence juridictionnelle exclusive des tribunaux de la province de l’Ontario.</p>
<p><strong>20. LANGUE :</strong> Les parties reconnaissent avoir exigé que ce contrat ainsi que tous les documents connexes soient rédigés en Français. The parties acknowledge that they have required that this contract and all related documents be prepared in French. Si l’acheteur en fait la demande, une version anglaise de ce contrat sera utilisée.</p>
